This individual communication has been submitted to the Human Rights Committee under the Optional Protocol to the International Covenant on Civil and Political Rights in 2007. In this communication, the Human Rights Law Centre argued that Australia violated the rights of a non-citizen who was a long-term resident of the country. In a landmark decision for non-citizens, the Committee found that Australia had violated article 12(4) (the right to enter his own country), and articles 17 and 23(1) (protection from arbitrary interference with his family life) of the ICCPR.
